Child Adoption provides a child with security, permanence, and love when his/her birth parents or biological family are unavailable or incapable of raising the child. If you adopt a child, you will be legally responsible for all parental liabilities of an adopted child. The commitment requires you to stay with it through the good times and the difficult ones. The physical and mental growth of a child through adoption is a way of giving them the love, stability, and nurturing environment they deserve. Original parents’ rights and responsibilities are transferred to adoptive parents after adoption. Upon adoption, the child becomes a permanent member of the new family. Parents who adopt a child have all the same rights and responsibilities as biological parents, and the adopted child has all the same benefits as a biological child in terms of psychology, socialization, and legal proceedings.

Child Adoption Law in Pakistan

Guardianship & child adoption is a great and appreciable act. Child adoption & guardianship is common.

Child Adoption in Pakistan is not governed by any law. You need to engage a lawyer once you decide to adopt from a family or an orphanage. The Lawyer will apply to the Family Court on your behalf. It takes about six to eight weeks for the legal adoption process to come to fruition with four or more hearing dates. Most of our clients who wish to adopt a child from Pakistan are located overseas, so in addition to assisting them in obtaining necessary court orders, our company, Right Law Associates (Pvt) Limited is able to arrange other documentation for the child to be able to move abroad.

There are some rules in Pakistan that must be kept in mind while adopting a child. These rules are:

  • An adopted child has no rights in the inheritance of parents who adopted him/her.
  • Adoption is considered good in Islam but the name of the parents of the adopted child cannot be changed, while the guardianship can be.
  • Muslim minors cannot be adopted by non-Muslim parents, same applies to Christians and other religions. 
  • Adoption & Guardianship deed is compulsory to be executed.
  • When a child is adopted, the maintenance rights are transferred to the adoptive parents, and then the child has the right to be maintained.
  • For foreign travel of the minors, approval from the Guardianship court must be taken.

Child Adoption Process:

There must be a written report by the adoptive parents and the medical report, also known as Form ICA, stating the following information:

  • Name of the child
  • Child’s date of birth
  • Place of birth
  • Adopt through the Family Court.
  • Name and address of the biological parents
  • At least three years of marriage are required for couples to qualify. (Copy of the marriage certificate would be required). 
  • At least 25 years of age is required for prospective adopting parents.
  • Raising a child must be affordable for the parents.
  • It is required that at least one parent be of Pakistani origin or eligible to obtain a Pakistani NICOP or CNIC.

Child Adoption Possiblity in the following two ways:

  • Directly From Parents of the Child or from an orphanage 

Through a Child adoption deed and its declaration by a civil court, you can adopt a child directly from parents. When you obtain a declaration decree in your favor, you may apply for a Guardian Certificate and Travel Permit from the Guardian Court. 

  • Child Protection and Welfare Bureau OR Sindh Child Protection Authority

The Department of Child Protection and Welfare, in Punjab Province of Sindh Child Protection Authority or a Guardian Court, can arrange for the adoption. Pakistani adoption procedures don’t allow infants to be taken to unrecognized centers. Instead, they must be taken to recognized centers or those run by child protection centers where procedures are handled. It is then necessary that you continue to make your case and convince him that you are a couple with the qualifications to adopt a child in Pakistan.

Prior to court, you must submit your complete profile, including the gender and age of the baby you are interested in adopting, as well as any other requirements for adopting a baby in Pakistan. The application must be based on a complete file prepared by a Pakistani lawyer. 

Furthermore, the adopter must provide personal information such as his or her occupation, age, religion, income, etc. Pakistan does not allow adoption from unapproved centers. Edhi, SOS Village, and other approved centers in Pakistan are the only places where it is possible. Adopting a child in Pakistan is only possible from a few government-approved agencies if you meet the requirements. The only evidence of your adoption in Pakistan is a certificate of adoption that your lawyer will issue after the entire case has been processed.

Guardians and Wards Act 1890:

The Guardians and Wards Act, 1890, is generally credited with establishing the law of guardianship and custody in Asian countries. 

In granting custody of minors to parents or, more traditionally, grandparents or relatives, guardian courts consider the minor’s welfare first. This law provides for custody to be granted to youngsters. A guardianship or custody proceeding in an exceptional family court typically involves three parties: 

  • The protective parent.
  • The nonprotective parent.
  • The Minor. 

Parental rights regarding custody are addressed in Sections 17 and 25 of the Guardians and Wards Act, 1890. Accordingly, “Hizanat” and “Willayat” are two of these rights. Typically, mother’s custody of minors is referred to as “Hizanat”, while the father’s custody is referred to as “Willayat”
